Notice of Health Department Notice

Looking for some help/advice on an ongoing situation in our building.

On March 23rd our building was issued a citation for the buildup of construction dust. (Essentially the contractor isn't following the terms of the TPP regarding clean up at the end of the day.)

After a second complaint was submitted, DOB returned to the building last week to collect dust samples and they posted a "Notice of Health Department Notice". (For some reason, I can't upload a picture of it.)

That was on the 16th and by the weekend, the notice was removed. Even though the notice clearly stated the following:

"No material, order or notice posted or required to be posted by the Department shall be mutilated, obstructed, torn down or removed unless authorized to do so by the Department or by this Code or other applicable law."

I called the number listed on the notice in order to get more information on the dust samples and the person I spoke with told me that it was too soon to receive any results. (I was expecting that.) I then asked him about the notice already being removed by the property manager and he essentially shrugged that off.

The gentleman from DOB said we should speak with our landlord. I'm pretty sure that's not going to go well. We're already dealing with a situation where the contractor is working after 6 o'clock and on weekends, even though they don't have an AHV permit, and they're already not following the terms of the Tenant Protection Plan.

So what's our next step?

I'm generally a supporter of 311 and have seen positive results after making submissions but this response from DOB really ticks me off. Is it now a situation where we need to reach out to our CM Crystal Hudson?

submitted by /u/BillyZoomTheCat
<a href="https://www.reddit.com/r/AskNYC/comments/1sqqpt9/notice_of_hea
